Terms of Service

1. Acceptance of these terms

By creating an account, installing the Marquis browser extension, or otherwise using Marquis (collectively, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree to any part of these Terms, do not use the Service.

2. Who can use the Service

You must be at least 13 years old to use Marquis. If you are using Marquis on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for any activity that happens under your account. Notify us immediately if you believe your account has been accessed without your authorization.

4. What the Service does

Marquis listens to audio that your browser can hear, transcribes it, and shows a translation in the language you select. Each recording session is saved as a separate file in your account, with both the verbatim transcript and an AI-generated structured summary. You can switch between the two views at any time.

5. Your content

You retain all rights to the audio you capture and to the transcripts and summaries generated from it ("Your Content"). You grant us a limited, worldwide, royalty-free license to host, process, transmit, and display Your Content solely for the purpose of operating the Service for you.

6. Acceptable use

You agree not to:
  • Record any person or conversation without the consent required by the laws of your jurisdiction.
  • Use the Service to infringe intellectual property rights, privacy rights, or other rights of any third party.
  • Use the Service to generate or distribute unlawful, harassing, defamatory, or otherwise harmful content.
  • Attempt to reverse engineer, decompile, or otherwise extract source code from the Service, except where permitted by law.
  • Probe, scan, or test the vulnerability of the Service, or circumvent any security or authentication measures.
  • Use the Service to build a competing product or to train a machine learning model.

7. Recording consent

Laws about recording and transcribing audio vary by country, state, and context. It is your responsibility to understand and comply with the laws that apply to you and to obtain any consent required from other participants before starting a recording.

8. Third-party services

The Service may rely on third-party providers for hosting, authentication, speech recognition, and translation. We do not control those providers, and your use of the Service is also subject to their applicable terms where they govern the underlying functionality.

9. Plans, fees, and changes

Some features may be offered as paid plans. Fees, billing cycles, and refund rules will be described at the point of purchase. We may change the features included in a plan with reasonable notice.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you materially breach these Terms, if required by law, or if continuing to provide the Service to you would expose us to legal or security risk.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis. We do not warrant that transcripts, translations, or summaries will be accurate, complete, or fit for any particular purpose. You should not rely on the Service for decisions that have legal, medical, financial, or safety consequences without independent verification.

12. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim arose, or one hundred United States dollars.

13. Indemnification

You agree to defend and indemnify us against any claim brought by a third party arising out of your use of the Service in violation of these Terms or of applicable law, including claims relating to content you record or share.

14. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will notify you through the Service or by email. Your continued use of the Service after the change takes effect constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws of the jurisdiction in which Marquis is operated, without regard to its conflict of laws principles. Disputes will be resolved in the courts of that jurisdiction, unless local consumer-protection law requires otherwise.
